GIFT VOUCHER TERMS & CONDITIONS

Your purchase is subject to Hand Picked Hotels’ terms and conditions for Gift Vouchers, which are explained here. Should you have any questions regarding these terms, please call our Central Reservations Office on 01642 706 606

1. Purchasing Gift Vouchers

You may purchase Hand Picked Hotels’ Gift Vouchers through a variety of channels, including our website, our Central Reservations Office and our hotels and spas. For security reasons, you may only purchase Gift Vouchers using a credit or debit card; we do not accept cash payments for Gift Vouchers. You undertake that all details you provide to Hand Picked Hotels for the purpose of ordering any Gift Vouchers are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the Gift Voucher ordered.

Gift Voucher purchases are only valid once you have paid for them in full and you receive a confirmation of purchase, which validates your purchase. Please check this confirmation carefully, as we may not be able to amend any issues at a later date.

Each Gift Voucher has specific terms and conditions of use, such as the product or service that it can be used for, the hotel(s) it is valid at, the days of the week on which it can be used and the expiry date by which it must be used. These terms and conditions are clearly shown to you when you purchase your Voucher; please check them carefully as we will not be able to amend them once the Gift Voucher has been issued.

All of our prices are inclusive of VAT (where applicable).
 
2. Receiving Gift Vouchers

You may choose to receive your Gift Voucher by email (for no extra charge), in person at a hotel (for no extra charge) or by post (for a postage & packing fee). 
Electronic Vouchers are issued immediately after purchase (subject to system uptime) and sent to your chosen email address. Hotel issued Vouchers are normally printed and issued to you upon purchase. 

We endeavour to dispatch any postal Gift Vouchers within 48 hours of purchase, but we cannot guarantee this and take no responsibility for delayed arrival of postal Vouchers. On rare occasions, our postal delivery partners may lose your Gift Voucher, in which case you should contact our Central Reservations team who will arrange for a replacement Voucher. Your original Voucher will be cancelled if a replacement is issued. 

3. Using Your Gift Vouchers

Gift Voucher use is subject to the attributes of the Voucher in question (such as product or service, hotel and day of week) and all Gift Vouchers have an expiry date after which your Gift Voucher can no longer be used. Some Gift Vouchers, in particular those relating to accommodation and spa bookings, are subject to availability at time of booking and we therefore strongly recommend that you book as early as possible to have the widest possible choice. Bookings can be made via our Central Reservations Office, directly at the hotel or in some cases on our website. We will use all reasonable endeavours to meet your requirements for booking but cannot guarantee any specific date or time. Please note that Hand Picked Hotels gift vouchers cannot be used to purchase national delivery meal boxes or click and collect items from the Hand Picked at Home service.

On the day of your booking, please bring your Gift Voucher with you and inform one of our team members that you wish to use it for payment prior to your experience. 

Please note that for security reasons you cannot use a Gift Voucher within 72 hours of purchase. 

4. Cancelling or Amending Gift Voucher Bookings

Should you cancel a booking made using your Gift Voucher, then the cancellation terms for that particular Voucher booking will apply and you can find these on each specific Voucher. 

If you cancel your booking within the permitted timings, your Gift Voucher will be reinstated to its full value and you can use it on another booking. If you cancel your booking outside the permitted timings, we will consider your Gift Voucher to have been used in full and you will not be able to use it on another booking.

5. Refunding Gift Vouchers

Under the Consumer Protection Contracts Information, Cancellation and Additional Charges Regulations 2013, you have the right to cancel your order with Hand Picked Hotels until 15 days from the day of receipt of your Gift Voucher(s). If you wish to cancel your order during this time, you should contact us and we will refund you the price (and delivery charge) you have paid for the Gift Voucher(s) within 14 days. Your statutory rights are not affected.

You cannot cancel and refund a Gift Voucher that has already been used.

7. Small Print

For legal reasons, we need to also include the following standard contractual clauses:

Limitation of liability
To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the services we offer you. This does not affect your statutory rights as a consumer under the Consumer Rights Act 2015 or your cancellation rights under these terms. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time these terms were entered into, both we and you knew it might happen. Nothing in these terms shall exclude or limit our liability for death or personal injury caused by our negligence or the negligence of our employees or Agents. In the event that Hand Picked Hotels breaches its contract with you, Hand Picked Hotels shall be responsible only for refunding the cost of the Gift Voucher. Hand Picked Hotels shall not be liable to pay any other compensation or losses suffered by you as a consequence of Hand Picked Hotels' breach of contract.

Your obligations
When staying at all of our hotels, you agree to comply with all licensing, health and safety, hygiene and all other applicable regulations. You also warrant that you will not cause damage to the premises. Hand Picked Hotels reserves the right to charge you the amount of making good any damage caused to our premises, as well as the cost of any items taken from our premises.

This agreement
Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect. Any provision of these terms that is expressly, or by implication, intended to come into or continue in force on or after termination of these terms shall remain in full force and effect. Each party agrees that it shall have no remedies in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these terms and conditions. 

Governing law
These terms and conditions are governed by English law.
